TasteAI User Agreement

Welcome to TasteAI. These Terms of Service ("Terms" or "Agreement") govern your access to and use of the TasteAI ordering platform, website, mobile experience, conversational ordering tools, and related services (collectively, the "TasteAI Service").

TasteAI is an AI-powered ordering concierge that helps guests discover menu items, receive recommendations, place orders, complete payments, and interact with participating restaurants through a conversational digital experience.

For this initial pilot, TasteAI is being made available at participating Lake Tahoe AleWorX locations and related venues ("Participating Restaurants").

By accessing or using TasteAI, creating an account, submitting an order, or selecting "I Agree," you acknowledge that you have read, understood, and agree to these Terms and our Privacy Policy.

If you do not agree to these Terms, please do not use TasteAI.

1. TasteAI's Role

TasteAI provides technology that facilitates interactions and transactions between you and participating restaurants.

TasteAI may assist you with:

  • Browsing restaurant menus
  • Receiving AI-generated food and beverage recommendations
  • Identifying menu items based on your preferences
  • Asking questions about menu items
  • Building and modifying an order
  • Ordering food and beverages
  • Processing or facilitating payment
  • Providing estimated preparation or fulfillment information
  • Communicating your table number or seating location
  • Accessing promotions, restaurant information, and other hospitality services

Verifying identity and age when required for restricted products such as alcoholic beverages.

Unless otherwise expressly stated, the participating restaurant remains responsible for preparing, selling, and fulfilling the food and beverages ordered through TasteAI.

TasteAI is the technology platform facilitating the ordering experience and is not the restaurant, food preparer, alcohol licensee, or manufacturer of products offered through participating restaurants.

2. AI-Powered Recommendations

TasteAI uses artificial intelligence to provide conversational assistance, menu information, recommendations, pairings, and other information.

Recommendations may be based on information including:

  • Your stated preferences
  • Previous interactions or orders
  • Dietary preferences
  • Menu availability
  • Popular menu items
  • Restaurant recommendations
  • Time of day
  • Current promotions
  • Group size
  • Other contextual information available to TasteAI.

AI-generated responses may occasionally be incomplete, inaccurate, or inconsistent with current restaurant information.

TasteAI should be treated as an ordering and recommendation tool rather than an authoritative source of health, medical, nutritional, or allergy information.

3. Allergies and Dietary Restrictions

If you have a food allergy, serious dietary restriction, or other food-related health concern, do not rely exclusively on TasteAI's recommendations or descriptions.

You are responsible for communicating allergies and dietary restrictions when ordering.

Ingredient information, preparation methods, substitutions, cross-contact risks, and menu availability may change without being immediately reflected within TasteAI.

If you have a severe or life-threatening allergy, please speak directly with a restaurant employee before placing or consuming your order.

TasteAI and participating restaurants cannot guarantee that any food or beverage is completely free from allergens or cross-contact unless expressly stated by the restaurant.

4. Orders and Menu Availability

Submitting an order through TasteAI constitutes a request to purchase the selected items from the participating restaurant.

Orders are subject to:

  • Restaurant acceptance
  • Product availability
  • Current pricing
  • Operating hours
  • Kitchen or bar capacity
  • Applicable laws
  • Age restrictions
  • Restaurant policies.

Menu items, ingredients, prices, promotions, and availability may change at any time.

TasteAI may recommend alternatives when an item is unavailable.

The participating restaurant reserves the right to reject, modify, or cancel an order when reasonably necessary.

5. Order Accuracy

Before submitting an order, you are responsible for reviewing:

  • Items selected
  • Quantities
  • Modifications
  • Dietary requests
  • Restaurant location
  • Fulfillment information
  • Total purchase amount.

Once an order has been submitted to the restaurant, modifications or cancellations may not be possible.

If you believe an order was submitted incorrectly, please contact a restaurant employee as soon as possible.

6. Pricing, Taxes, Fees and Gratuities

Prices displayed through TasteAI are intended to reflect pricing established by the participating restaurant.

Your final transaction may include:

  • Menu item charges
  • Applicable taxes
  • Service charges
  • Gratuities
  • Other restaurant-authorized fees
  • Any other amounts disclosed before checkout.

You will have an opportunity to review the applicable total before submitting payment.

7. Payment

TasteAI may integrate with third-party payment processors and restaurant point-of-sale systems to facilitate transactions.

By submitting payment information, you authorize the applicable restaurant and payment processor to charge your selected payment method for the amount displayed at checkout.

TasteAI does not necessarily store your complete payment-card information. Payment information may instead be securely processed and stored by authorized third-party payment providers. Separate terms and privacy policies of those providers may apply.

8. Open Tabs and Additional Orders

Where available, TasteAI may allow you to authorize a payment method and maintain an open restaurant tab.

If you choose to keep a tab open, you authorize additional orders that you affirmatively place through your TasteAI session to be added to that tab.

You are responsible for maintaining control over your device and TasteAI session.

Before closing your tab, you will have an opportunity to review applicable charges in accordance with the functionality available through the participating restaurant's payment system.

9. Alcoholic Beverages

TasteAI may allow eligible users to order alcoholic beverages from appropriately licensed participating restaurants.

You must be 21 years of age or older to purchase, receive, possess, or consume alcoholic beverages through TasteAI.

By attempting to purchase an alcoholic beverage, you represent that you are legally permitted to do so.

Identity and Age Verification

TasteAI may require identity and age verification before allowing an alcohol order to proceed.

TasteAI may use a third-party identity verification provider, including Persona, to assist in verifying your identity and legal drinking age.

Depending on the verification process, you may be asked to provide information such as:

  • Name
  • Date of birth
  • Government-issued identification
  • Photograph or selfie
  • Device or verification information
  • Other information reasonably required to confirm identity or age.

Additional terms and privacy disclosures associated with the identity verification provider may apply.

Successful digital verification does not guarantee that alcohol will be served or released to you.

The participating restaurant retains the right and responsibility to comply with applicable alcohol laws and responsible-service requirements.

Restaurant personnel may request physical identification or perform additional verification before providing an alcoholic beverage.

Alcohol service may be refused or canceled if:

  • You cannot provide acceptable identification
  • Your identity cannot be verified
  • You are under 21
  • Your identification appears invalid or fraudulent
  • You appear intoxicated

The restaurant determines that service would violate applicable law or its responsible-service policies; or

Restaurant personnel otherwise determine that alcohol should not be served.

A successful TasteAI or third-party age verification does not override the judgment or legal responsibilities of restaurant personnel.

10. Account and Guest Information

TasteAI may allow you to create a user profile or use certain functionality as a guest.

Your profile may contain information such as:

  • Name
  • Email address
  • Phone number
  • Ordering history
  • Food and beverage preferences
  • Dietary preferences
  • Favorite items
  • Other information you choose to provide.

You agree to provide accurate information and to keep account credentials reasonably secure.

You are responsible for activity conducted through your account or device to the extent permitted by applicable law.

11. Personalization

TasteAI may use your interactions and preferences to personalize future experiences.

For example, TasteAI may remember:

  • Previous orders
  • Favorite menu items
  • Food preferences
  • Beverage preferences
  • Dietary preferences
  • Preferred modifications
  • Other information you voluntarily provide.
  • Personalization is intended to make future interactions faster and more relevant.
  • The collection and use of personal information is governed by the TasteAI Privacy Policy.

12. Pilot and Prototype Technology

You acknowledge that TasteAI may initially be provided as a pilot, beta, MVP, or prototype service.

During the pilot period:

  • Features may change
  • Functionality may occasionally be unavailable
  • Responses may contain errors
  • Integrations may experience delays
  • Orders may require restaurant staff intervention
  • Certain features may be added, removed, or modified

TasteAI may temporarily suspend functionality for testing or maintenance.

We appreciate feedback about your experience and may use feedback to improve TasteAI.

13. Restaurant Fulfillment

Participating restaurants are responsible for preparing and fulfilling accepted orders.

Estimated preparation, pickup, or fulfillment times provided by TasteAI are estimates only and are not guaranteed.

Actual fulfillment times may vary based on:

  • Order volume
  • Kitchen capacity
  • Bar capacity
  • Staffing
  • Item complexity
  • Restaurant conditions
  • Other circumstances outside TasteAI's control.

TasteAI may communicate restaurant-provided estimates but does not guarantee fulfillment within a specific period.

14. Seating and Fulfillment Information

TasteAI may request information such as:

  • Table number
  • Seating area
  • Venue location
  • Pickup preference; or
  • Other information necessary to help restaurant employees locate you or fulfill your order.

You are responsible for providing accurate fulfillment information. Providing incorrect information may delay your order.

15. Acceptable Use

You agree not to:

  • Use TasteAI for unlawful purposes
  • Attempt to purchase age-restricted products if you are not legally eligible
  • Provide false identity or age information
  • Use another person's identification
  • Attempt to circumvent identity or age verification
  • Fraudulently dispute legitimate charges
  • Attempt unauthorized access to TasteAI systems
  • Interfere with TasteAI functionality
  • Introduce malicious software or code
  • Scrape or systematically extract TasteAI data without authorization
  • Reverse engineer the platform except where legally permitted; or

Use TasteAI in a manner that harms TasteAI, participating restaurants, employees, or other users.

TasteAI may restrict or terminate access when we reasonably believe these Terms have been violated.

16. Privacy

Your privacy is important to us.

TasteAI's collection, use, retention, and disclosure of personal information is described in the TasteAI Privacy Policy, which should be reviewed together with these Terms.

Certain services—including payment processing and identity verification—may involve third-party providers that maintain their own privacy practices.

17. Intellectual Property

TasteAI and its associated:

  • Software
  • AI systems
  • User interface
  • Designs
  • Branding
  • Logos
  • Content
  • Recommendation systems
  • Technology
  • Other intellectual property

are owned by or licensed to TasteAI and are protected by applicable intellectual property laws.

These Terms provide you with a limited, personal, non-exclusive, non-transferable right to use TasteAI for its intended consumer ordering purposes. They do not transfer ownership of TasteAI technology or intellectual property to you.

18. Third-Party Services

TasteAI may integrate with third-party services including:

  • Restaurant point-of-sale systems
  • Payment processors
  • Identity verification providers
  • Messaging services
  • Analytics providers
  • Other technology partners.

TasteAI is not responsible for third-party services to the extent permitted by applicable law.

Your use of certain third-party services may be governed by additional terms and privacy policies.

19. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TASTEAI IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS.

TasteAI does not guarantee that:

  • The service will always be available or error-free
  • AI-generated information will always be complete or accurate
  • Every recommended item will meet your preferences
  • Restaurant menu information will always be current
  • Every order will be accepted or fulfilled; or
  • Estimated preparation times will be exact.

Nothing in these Terms excludes warranties or rights that cannot legally be excluded.

20. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TASTEAI AND ITS AFFILIATES, OFFICERS, EMPLOYEES, CONTRACTORS, AND TECHNOLOGY PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM OR RELATING TO YOUR USE OF TASTEAI.

Any limitation of liability shall apply only to the extent permitted by applicable law.

Nothing in these Terms limits liability that cannot legally be limited or excluded.

21. Problems With an Order

If you experience an issue involving:

  • Incorrect items
  • Missing items
  • Food quality
  • Preparation
  • Fulfillment
  • Refunds; or
  • Restaurant service,

please contact the participating restaurant or follow the support instructions presented within TasteAI.

22. Changes to These Terms

TasteAI may update these Terms as the service evolves.

If material changes are made, we may provide notice through TasteAI or another reasonable method.

The effective date displayed at the beginning of these Terms indicates when the current version became effective.

23. Governing Law

These Terms are governed by the laws of the State of Nevada, without regard to conflict-of-law principles, except where applicable law requires otherwise.

Any venue, dispute-resolution, arbitration, class-action waiver, or other dispute provisions should be separately reviewed and approved by TasteAI's legal counsel before being incorporated into these Terms.

Acceptance

By selecting "I Agree," "Continue," "Create Account," "Place Order," or another clearly identified acceptance mechanism presented with these Terms, you acknowledge that you have read and agree to the TasteAI User Agreement and Privacy Policy.

For alcohol purchases, you further acknowledge that you must be 21 years of age or older, may be required to complete identity and age verification, and may still be required to present acceptable identification to restaurant personnel before receiving an alcoholic beverage.
